新傳播科技的發展與普及，改變了閱聽人的媒介使用習慣，並帶動相關行業的興起，錄影帶出租業就因此而勃與。

新科技、新行業對各國政府而吉都是新課題、新挑戰，必需制訂新的管理法令配合之。台灣地區錄影帶出租業於無法令約束的時代興盛，法規逐漸齊備時，便因與上游發片商間的產銷關係改變而趨衰敗。本研究的目的即在探討我國及其他先進國家的相關法律規定，並藉全省性出租業的抽樣調查發現其經營問題，期能找出本行業當前困境的解答。

在相關法令方面，本文探討了美國著作權法、英國錄影物法、德國有關兒童和青少年的保護措施，以及我國的著作權法和相關行政管理。

問卷調查結果則發現，當前錄影帶出租業的問題癥結在於與發片商間的購片契約不合理，受制於發片商，造成經營困難;出租業者則經營非法帶情形十分普遍，因而無法擺脫契約的束縛。

本文最後對現行的若干規定提出意見，供制訂政策、法令者參考;並向發片商及出租業者提出建言，期能建立共識，使本行業的經營合理化。
