人權問題目前已是國際法中一個重要的課題。但是過去對於何謂「人權」，似乎缺乏一個普遍公認而又明晰的概念。一九四八年十二月聯合國大會通過世界人權宣言，其中揭示了若干人權作為人類共同遵守的標準，至此才可說是為人權下了一個共通的定義。

歐洲人權公約雖然僅是一個區域性的人權公約，但是這份公約的締約國除了盡力實踐世界人權宣言之外，也不斷增訂保障人權的條款；此外，它所創設保障人權的監督機構所實踐的經驗，也都是值得全世界留意的。本論文研究的宗旨，就是針對此公約所保障的人權，以及其所設監督機構運作的方式作詳盡的探討，最後再檢討其實行的績效。

本論文共分六章，共約九萬餘字。第一章概述歐洲人權締結的緣起，以及締結五個補充議定書的原因和內容。第二章說明本公約與議定書所保障的權利與自由。第三章與第四章分別說明歐洲人權委員會、和歐洲人權法院，它們的成員、職權、和執行任務的程序。第五章說明歐洲理事會的部長聯席會在本公約內所擔任的角色，以及執行任務的程序。第六章檢討歐洲人權公約締結以來的成就及其缺失。

本論文得以完成，首先必須感謝筆者的指導教授李鍾桂博士。由於筆者缺乏寫作論文的經驗，不免造成許多疎失，幸賴李教授一一指正，並代為潤飾文辭。李老師不時諄諄教誨筆者，有嚴苛也有關懷，實令筆者銘感肺腑。另外遠在法國史他斯堡進修的友人吳德揚先生惠寄許多資料，謝武樵同學提供若干具體的意見，還有政大合唱團陸偉明、周婉玲、鄭張國等團員協助繕稿，在此一併致謝。筆者初習論文，疎漏在所難免，筆者自當負責，尚請各位先進不吝賜教。
