隨著網路科技之快速發展，電子商務作為現代企業主要提供之服務或商品之平台。由於電子商務具有跨區域性，跨國間彼此合作以及規範的調和即成了電子商務能否持續蓬勃發展之重點。
在國際場域中，尤其世界貿易組織之框架下，由於談判的停滯以及未有足夠關於數位貿易之討論，電子商務相關條款之規範尚未有所進展。因此，各國開始將電子商務之相關議題放入自由貿易協定中討論。是以，觀察與分析電子商務交易興盛國家，美國、歐盟以及亞太地區相關自由貿易協定中電子商務章節之規範，對於了解當代電子商務相關法律議題以及政策環境有其必要性。
本研究透過比較法之方式，歸納出美國重視數位產品不歧視原則且強調網路服務提供者應保持競爭並注重資料跨境流通、伺服器在地化與原始碼的問題；歐盟強調個人資料保護，並規範網路中介者責任與未經同意之商業電子訊息等；亞太地區中，日本早期注重無紙化貿易，之後要求技術標準之訂立應由市場主導，也開始將產業未來趨勢發展的考量放入FTA。韓國與新加坡受美國影響深遠，但特別注重個人資料，新加坡特別強調大眾傳播服務之保護。澳洲強調國內規章應由產業自行主導，對其他條款較尊重各締約國。最後，中國保留將來可調整電子傳輸關稅的權利也對電子認證機構有特殊要求，相關條款也不可訴諸爭端解決，對於電子商務管制的力道比較強。在觀察出上面之面向後，本文建議政府應從個人資料保護與資料跨境流通、消費者保護以及未經同意之商業電子訊息之三個議題為較值得檢討與修改，另外，業者亦應對相關議題多加留意。
