本論文探討中國共產黨(CCP)如何運用法律戰(法律戰)推進其對臺灣主權主張。雖然臺灣始終是中共法律戰最主要的目標,但其離島地區尤為脆弱。近年來,隨著中共提出所謂的「金門模式」,金門逐漸成為法律戰運作的重要焦點。基於此,本研究提出兩項核心問題:中共為何推動金門模式?以及中共如何透過法律戰對金門施加影響?
本研究透過田野調查、深度訪談,以及系統性追蹤中共法律戰相關發展,分析中共如何將法律戰作為其整體統一戰略的一部分加以運作。本文主張,中共法律戰根植於中國共產黨對主權的排他性理解,因此有別於西方對「Lawfare」的認知。法律戰並非用以取代軍事力量,而是透過建構司法管轄權與領土主張的正當性,為其軍事與政治目標提供合法化依據與支持。
本論文將中共對金門的法律戰分為三個階段進行分析:第一,塑造有利環境;第二,建立擴張管轄權的法律與執法機制;第三,透過金門模式追求政治勝利。研究結果顯示,金門模式具有四項主要戰術功能:促進經濟合作、推動基礎設施滲透、擴張司法管轄與領土主張,以及作為挑戰臺灣主權敘事的戰略欺敵工具。這些措施相互配合,不僅逐步常態化中共在金門周邊的存在,也為其推進統一框架創造有利條件。
本研究認為,中共法律戰已構成日益嚴峻的國家安全威脅,亟需採取整合性的應對措施。在國家層面上,臺灣應將法律戰視為中共用以正當化脅迫行為的核心戰略之一,並建立統一的反法律戰應對架構,以提升社會大眾對法律戰威脅的認識,強化金門的整體韌性。此外,若政府能加強對金門的財政支持,推動提升自主能力的關鍵基礎建設,例如海水淡化廠、衛星網路、綠色能源系統,以及高品質教學醫院等,不僅能增強金門的自給自足能力,也有助於強化地方政府機構對中華民國(臺灣)的認同與忠誠,並提升居民維持自主性的能力,而這些都是有效反制中共法律戰的重要基礎。
This thesis examines how the Chinese Communist Party (CCP) employs legal warfare (法律战) to advance its sovereignty claims over Taiwan. While Taiwan remains the CCP's most consistent target of legal warfare, its offshore islands are particularly vulnerable. In recent years, Kinmen has emerged as a focal points with the introduction of the CCP's self-described“Kinmen Model” (金門模式). Which leads this study to ask two questions: Why is the CCP using the Kinmen Model, and how is legal warfare being applied against Kinmen?
Drawing on fieldwork, interviews, and the systematic tracking of CCP legal warfare developments, this research analyzes how the CCP operationalizes legal warfare as part of its broader unification strategy. It argues that CCP legal warfare is rooted in the Party’s exclusive conception of sovereignty, distinguishing legal warfare from Western understandings of lawfare. Rather than replacing military force, legal warfare serves to legitimize and support military and political objectives by justifying the CCP’s jurisdictional authority and territorial claims.
The thesis examines CCP legal warfare through three stages: preparing a favorable environment, constructing legal and enforcement mechanisms to expand jurisdiction, and pursuing political victories through the Kinmen Model. The findings identify four tactical roles of the Kinmen Model: promoting economic cooperation, facilitating infrastructural infiltration, expanding jurisdictional and territorial claims, and serving as a tool of strategic deception in narratives challenging Taiwan’s sovereignty. Together, these measures normalize CCP presence while advancing a unification framework.
The study concludes that CCP legal warfare constitutes a growing national security threat that requires a coordinated response. On the national level, Taiwan should recognize legal warfare as a core component of CCP strategy to legitimize coercion, so Taiwan should develop a unified counter-legal warfare framework. This would in turn strengthen public awareness and enhance Kinmen’s resilience. Further, if Taiwan strengthened its financial support for Kinmen with projects that increase self-sufficiency by investing in critical infrastructure (desalinization plant, satellite internet, green energy, and invest in a high-quality teaching hospital), these projects would reinforce the loyalty of local government institutions and the capacity for Kinmen residents to maintain autonomy—both are critical to effectively counter CCP legal warfare.
