隨著兒童透過網路使用數位服務的頻率日益提高，兒童於數位環境中所面臨的風險是與個人資料的蒐用、剖析及演算法推薦密切交織。然而，相較成年人，兒童對個人資料蒐用的理解、風險判斷及控制資料流向的能力較弱，且正處於人格、身分認同與價值觀的發展階段，是以，數位服務提供者對兒童個人資料的蒐用，對其隱私權、身心發展與整體福祉可能造成更深遠的影響。然而，我國現行法制多仍以成年人作為個人資料保護的預設對象，或僅針對特定兒童、特定資料類型與特定行政目的為規範，未能回應數位服務提供者大量蒐用兒童個人資料所形成的新興風險。基此，有必要重新檢視我國兒童個人資料保護制度，並思考如何建構適用於數位環境的兒童個人資料保護制度，以作為兒童網路使用防護的一環。
本文以《兒童權利公約》第25號一般性意見作為制度建構基礎，參酌美國、歐盟、中國的比較法制，分析我國可能採取的規範路徑。本文主張，我國應以兒童權利公約的四大原則為核心，並考量兒童具有不斷發展的能力，建立「父母同意模式」的兒童個人資料蒐用規範，並搭配年齡驗證、從設計保護隱私、父母同意驗證、父母資料控制權、演算法限制、個人資料影響評估、兒童權利影響評估等配套機制。最後，透過跨機關協力制定專法，明確規範數位服務提供者之義務，落實兒童於數位環境中的個人資料保護，以期在數位科技快速變遷的當代，為兒童提供更完整的制度保障，守護其健康快樂的童年。

As children increasingly access digital services, the risks they encounter in the digital environment have become intricately intertwined with data processing, profiling, and algorithmic recommendations. Compared to adults, children possess more limited capacities to understand data processing practices, assess associated risks, and control the flow of their personal data. Furthermore, as children are in a critical stage of developing their personality, identity, and values, the processing of their personal data by digital service providers may have profound and lasting impacts on their privacy, physical and mental development, and overall well-being. However, Taiwan’s current legal framework remains predominantly adult-centric or only regulates specific groups of children and types of data for limited administrative purposes. Consequently, it fails to adequately address the emerging risks arising from the large-scale processing of children's personal data. Accordingly, there is an urgent need to re-examine Taiwan’s legal framework and construct a robust regime tailored to the digital environment as a vital component of children’s online protection.
This thesis takes General Comment No. 25 to the Convention on the Rights of the Child (CRC) as its theoretical foundation and draws on comparative legal analyses of the United States, the European Union, and China to explore potential regulatory pathways for Taiwan. It argues that Taiwan should adopt the four general principles of the CRC as its core, while accounting for the "evolving capacities of the child," to establish a framework centered on parental consent. This framework should be integrated with supporting mechanisms such as age verification, Privacy by Design (PbD), parental consent verification, parental data control, algorithmic restrictions, Data Protection Impact Assessments (DPIA), and Children's Rights Impact Assessments (CRIA). Finally, this thesis proposes the enactment of a special law through inter-agency cooperation to clearly define the obligations of digital service providers, thereby ensuring comprehensive institutional protection for children and safeguarding a healthy and happy childhood in the digital age.
