  • 本研究以Meta為核心個案,探討假訊息治理中平臺責任之形成、運作與限制,並比較美國、歐盟與臺灣不同制度環境下的平臺治理模式。隨著大型數位平臺掌握資訊排序、演算法推薦、廣告投放與資料運用等能力,平臺已不再只是被動的資訊中介者,其治理責任亦逐漸成為數位治理的重要議題。
    本研究採質性研究取徑,運用文獻分析法、文件分析法、個案研究法及比較法研究法,分析Meta官方政策文件、美歐相關法規與判例、臺灣政策資料及國內外學術文獻。研究發現,平臺責任並非由「中介者免責」線性發展至「全面監管」,而是在不同法律文化、制度設計、政治社會環境、技術條件與商業誘因下形成不同的責任配置。美國以第一修正案、《通訊端正法》第230條及平臺自治為重要基礎;歐盟則以基本權保障、系統性風險治理與程序問責為核心,透過《數位服務法》(DSA)要求大型平臺承擔風險評估、透明度及外部問責等義務。
    研究亦發現,Meta由第三方事實查核轉向社群備註(Community Notes),並非單純治理工具的替換,而是平臺、專業查核組織與使用者之間責任的重新配置。
    本研究認為,未來平臺責任應由個別內容治理逐步轉向系統責任,要求平臺對其可控制的演算法推薦、廣告系統、治理程序與風險管理承擔相應責任,同時以言論自由與程序正義限制治理權力的擴張。對臺灣而言,未來制度設計應優先強化透明義務、申訴救濟、資料近用及外部監督,逐步建立兼顧言論自由與平臺問責的治理架構。
