本文針對腦機介面研究之運用,嚐試論述思想自由之保障內涵及干預界限為何。先於第1章「緒論」,介紹何謂腦機介面,說明其定義尚未統一,並提出本文界定,以及其干預心智思想之問題意識。並概述美國及我國腦機介面研究之發展與背景,包括其緣起、發展與未來運用潛力等。最後則提出本文之研究目的及方法。再於第2章「腦機介面運用之分類與問題」,說明腦機介面之運用,可依不同標準分成不同種類,各有特性。之後再就其運用之倫理問題與基因科技比較,發現最大差異點,在於心智思想之探知及改變。此並可由大腦神經科學及電腦學之角度,分別論述。最後,倫理問題與法律問題係相互影響、補充,尤其反應在憲法基本權利保障及干預之上,腦機介面若為公權力措施運用,將不可避免產生思想自由之保障及干預問題。而於第3章「腦機介面研究之運用與思想自由的保障」, 則就公權力運用腦機介面探知或改變人民心智思想,可能涉及之各種基本權利中,以未列舉權居多。但是各項基本權利,均無法完整表彰問題,故競合與整合後,應以思想自由作為審查之主要依據,並以人性尊嚴作為背後最高的指導原則。依此本文嚐試提出思想自由之保障內涵,認為除受絕對保障之純粹思想外,亦應及於受相對保障之傳來思想,不論有無外在行為。以及思想自由之保障,應著重於思想自由之3項權能:思想能力、思想輔助、思想具現,並分別舉例說明。繼於第4章「腦機介面研究之運用與思想自由的干預界限」,本文認為公權力措施依其目的及手段的不同,干預心智思想之情形亦有不同。但是除直接探知與改變者外,公權力措施干預與心智思想具有緊密關聯性之外在行為,手段若又係以違反說服原則之方式為之,應認定係干預思想自由。並藉由精神藥物、大腦指紋及印度法院2008年運用腦機介面作為被告定罪依據等例之討論,主張此時憲法應從嚴審查。之後再以思想自由之3項權能,分別舉例提出憲法所可能容許之干預界限。最後就腦機介面研究之運用,經審查後,發現幾乎不可能通過利弊權衡,故結論將難以通過合憲性檢驗。末於第5章「結論」,則建議對於有關科技應增加論述,並適時調整法令,藉以保障思想自由,落實人性尊嚴作為憲法基本權利保障及干預最高指導原則之精神。
