論文摘要

本論文除參考書目及附錄外共七萬餘言，分五章，九節。各章內容約略如下：

第一章、緒論。敍述研究動機、方法及研究重點。

第二章、中美共同防禦條約之簽訂與廢止。敍明訂約之背景、條約性質、條約的內容分析和尼克森與卡特兩位總統在美中（共）「關係正常化」過程中所採取的態度與互助關係。

第三章、美國憲政史上的廢約先例。分從國會單獨廢約、總統與國會共同廢約和總統單獨廢約三方面來討論廢約的先例。

第四章、美國總統締約權與廢約權之爭論。分別探討締約權之由來，學者專家對總統應如何行使廢約權之意見和高華德控訴卡特一案之三級法院之判決。

第五章、結論。就研究心得來看美國總統是否可獨享廢約權？以及此次卡特廢止中美共同防禦條約所造成之影響。

本論文撰寫期間，遭逢到不少思維上之窒礙及資料蒐集之困難，幸賴指導教授陳明老師在百忙中仍予悉力啟迪與指正，及陳師治世在章節安排、文字潤飾與內容斟酌均經斧正，在此謹致最誠敬之謝忱。

叩謝雙親多年來之養育，栽培及摯友麗珠在精神上無限之支持，盼本文之完成能慰藉父母及家人之期勉於萬一。
