新冠疫情不僅造成全球公共衛生危機,亦凸顯既有國際衛生治理於大流行防範、準備與應對上之制度侷限。為應對早期預警遲滯、跨國協調失靈,以及疫苗與關鍵醫療資源分配不均等問題,國際社會遂於後疫情時代推動《大流行病協定》,並將健康一體納入協定中,使其由過往之政策倡議,進一步進入國際法規範架構之中。
本文以《大流行病協定》之健康一體為研究核心,探討其在協定中之規範定位、制度功能及實踐挑戰。健康一體強調人類健康、動物健康與環境之密切關聯,主張以多部門協作、資訊整合與整體風險治理回應日趨複雜之健康議題。《大流行病協定》透過將健康一體納入相關條款,使其成為大流行防範、準備與應對之重要理念,並為多部門協作、資訊整合及預防性治理提供制度依據。
本文認為,《大流行病協定》雖未使健康一體形成具高度拘束力之法律義務,但其被納入協定後,仍取得一定之條文基礎,並為後疫情時代國際衛生治理提供方向。健康一體之後續發展,亦未必僅取決於協定本身,或可透過融資、技術及區域合作等方式,逐步累積其實踐基礎。
The COVID-19 pandemic exposed major weaknesses in existing international health governance, particularly in pandemic prevention, preparedness, and response. In response to delayed early warning, failures in cross-border coordination, and inequitable access to vaccines and other critical medical resources, the international community promoted the Pandemic Agreement in the post-pandemic era and incorporated One Health into the Agreement, moving it beyond its earlier role as a policy initiative into the framework of international law. This thesis examines the normative status, institutional functions, and practical challenges of One Health under the Pandemic Agreement. It argues that the incorporation of One Health provides a clearer normative foundation in international law and an institutional basis for multisectoral cooperation, information integration, and preventive governance. Although the Pandemic Agreement does not make One Health a highly binding legal obligation, its inclusion in the Agreement still gives One Health a treaty-based textual foundation and provides a broader institutional direction for global health governance in the post-pandemic era. The further development of One Health may not depend solely on the Agreement itself. Its practical foundation may also be gradually built through institutional arrangements such as financing, technical cooperation, and regional collaboration.
